With the passage of the Texas abortion bill and the U. S. Supreme Court’s refusal to intervene, it is about time abortion was banned. There is no constitutional protection for abortion. Just as there is no specific protections for adultery, gay relationships, acquiring a tattoo or any number of human activities that pique religious conservatives. The door will now be opened to criminalize any human activity that elected conservative fanatically religious officials find offensive and is not specifically mentioned in the constitution as being protected.
Banning Abortion Should Be A Loud Alarm Bell
I am sincere when I say that it is time that abortion was banned. This is the loud morning alarm signal for people who have been sleeping through the assault on human and civil rights in our country under the guise of some quasi-religious argument that the constitution and our country’s independence was somehow inspired by God.
It has taken a president who had more allegiance to money and his white nationalist base of voters than he had to the principles of the constitution to appoint Supreme Court Justices who are literalists and originalists. The constitutional literalists, who adhere to the concept of originalism, do not believe that the constitution is a living document where interpretations can be adapted for an evolving of society. For the originalists, if an activity was not specifically mentioned in the constitution, then there is no protection for that human activity that injures no one.
The Trump justices would have easily agreed with the Dred Scott decision where the United States Supreme Court in 1857 ruled a black man was not entitled to freedom. Why? Because the constitution never mentions that black people should be free and slavery was a commonly practiced business activity when the constitution was written. If it not were the constitutional amendments banning slavery and granting women the right to vote, the Trump justices would oppose those protections also.
Constitutional Protections For A Woman’s Right To Privacy
A woman’s right to an abortion should be a constitutional amendment. Only when a woman’s health care decisions are specifically enumerated within the constitution will this religious fascism dictating what a woman can do with her body finally be subdued.
I feel horrible that the Texas anti-abortion law will cause immense suffering for thousands of women. However, I hope this draconian religiously inspired law will be the tipping point that finally makes men and women band together to fight for and demand protection for basic human rights.
